Employment-Based Immigration: very First Preference EB-1

You might be eligible for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an or employment scientist, or are a certain multinational executive or supervisor. Each occupational category has certain requirements that must be met:

Your petitioning employer must be a U.S. company and intend to employ you in a supervisory or executive capability. The petitioner needs to have been doing company in the U.S. for a minimum of 1 year, as a legal entity with a certifying relationship to the entity that utilized you abroad in a supervisory or executive capacity.

No labor accreditation is needed.

* Criteria for Demonstrating Extraordinary Ability

In order to show you have sustained nationwide or worldwide praise which your achievements have been acknowledged in your field of expertise, you must either include evidence of a one-time accomplishment (significant internationally-recognized award) or 3 of the 10 listed requirements listed below (or similar evidence if any of the requirements do not readily apply):

– Evidence of receipt of lower nationally or internationally recognized rewards or awards for excellence

– Evidence of your membership in associations in the field which require outstanding achievement of their members

– Evidence of released material about you in professional or significant trade publications or other major employment media

– Evidence that you have actually been asked to evaluate the work of others, either individually or on a panel

– Evidence of your initial clinical, scholarly, artistic, athletic, or business-related contributions of significant significance to the field

– Evidence of your authorship of academic short articles in professional or significant trade publications or other significant media

– Evidence that your work has been shown at creative exhibits or showcases

– Evidence of your efficiency of a leading or vital role in prominent organizations

– Evidence that you command a high income or other substantially high remuneration in relation to others in the field

– Evidence of your industrial successes in the carrying out arts

** Examples of Documentary Evidence That an Individual is an Exceptional Professor or Researcher

In order to show you are an exceptional teacher or scientist, you should include evidence of 2 of the 6 listed requirements listed below (or equivalent proof if any of the requirements do not easily apply):

– Evidence of receipt of significant rewards or awards for outstanding achievement

– Evidence of membership in associations that require their members to demonstrate impressive accomplishment

– Evidence of published product in professional publications composed by others about the alien’s work in the academic field

– Evidence of involvement, employment either on a panel or separately, employment as a judge of the work of others in the exact same or allied academic field

– Evidence of initial scientific or scholarly research study contributions in the field

– Evidence of authorship of scholarly books or short articles (in academic journals with international flow) in the field

Application Process

Extraordinary Ability: You may get yourself by filing a Kind I-140, Petition for Alien Worker.

Outstanding Professors and employment Researchers: Your U.S. company must file a Form I-140, Petition for Alien Worker. As part of the application process, your company should have the ability to demonstrate a continuing capability to pay the used wage since the concern date. Your employer may utilize an annual report, federal income tax return, or audited monetary declaration to demonstrate a continuing ability to pay your wage.

Multinational Manager or Executive: Your U.S. employer should file USCIS Form I-140, Petition for Alien Worker. As part of the application process, your employer must be able to show a continuing capability to pay the used wage since the priority date. Your employer may use an annual report, federal tax return, or audited monetary statement to show a continuing ability to pay your wage.
